Impact of Michigan No-Fault Auto Insurance Reform

Session description and objectives:

Numerous public policy and legislative issues around healthcare delivery and public health affect healthcare organizations and demand the involvement of their leaders to respond and adjust organizational policies and procedures.

On “May 30, 2019, Governor Whitmer signed historic bipartisan no-fault auto insurance reform legislation (Public Acts 21 and 22 of 2019) to provide insurance coverage options, and lower rates for Michigan drivers while maintaining the highest benefits in the country, and strengthening consumer protections.” https://www.michigan.gov/autoinsurance/0,9555,7-405-96983_96984—,00.html These changes took effect July 1st, 2020.

Michigan had the highest auto insurance benefits and had the highest costs since unlimited Personal Injury Protection (PIP) medical Mandatory benefits were mandatory. Not everyone could afford the unlimited coverage so many were driving uninsured. With the new law, drivers could reduce their premiums for the medical portion of PIP by relying on their own health insurance for their medical bills or they could continue with unlimited lifetime PIP medical benefits.

Although the new law has permitted drivers to save on insurance, it has caused many additional challenges for healthcare providers and legal experts to provide quality care for patients impacted by automotive-related injuries.

Learning about the impact of these changes and being involved in policy and organizational responses is important for healthcare leaders, regardless of how directly they may be involved. This session will examine some of the challenges of caring for patients with automotive-related injuries.

Objectives for this session include:

* Explore the impact on a broad range of care providers and their legal advocates

* Understand the challenges for patients in coordinating and receiving care

* Impact of the changes on families and caregivers

* Current efforts and potential for future changes in legislation

Panelists:

Tiffany Youngs-Bokas, Chief Operating Officer, Kennedy Care, Ann Arbor, a home care agency serving hundreds of clients, including those catastrophically injured since January 2022.

Owen Perlman, MD, Associate in Physical Medicine and Rehabilitation, P.C., Board-Certified specialist in Physical medicine and rehabilitation. He also serves as Medical Director for Post-Acute Residential and Outpatient Traumatic Bran Injury Programs including Rainbow Rehabilitation Center, Resilient Life Center, and Resilire Neuro Rehab

Wayne Miller, Esq., Miller and Tischler, P.C. and Adjunct Professor, Wayne State University with a focus on Automobile No-Fault Insurance since 1998.
